Privacy Policy

Pool & Associates, Inc. d/b/a Passport Unlimited in Nebraska, Indiana, Iowa, Kansas, and Missouri (or “Passportunlimited.net” or ”Pool & Associates or “Passport Unlimited Midwest”) is committed to your privacy as users of the Passport dining program and the Passportunlimited.net website. Pool & Associates, Inc. d/b/a Passport Unlimited in Nebraska, Indiana, Iowa, Kansas, and Missouri operates under a license to use Passport Unlimited trademarks and operates independently from Passport Unlimited, Inc. (or passportunlimited.com). The privacy and security practices of Pool & Associates are unique and distinct from those of Passport Unlimited, Inc. When in the process of using the Passport dining program, you opt to be directed to websites other than Passportunlimited.net to access program information or services (“Passportunlimited.com” or “Passportdining.com” or the website of any third-party vendor associated with “Passportunlimited.com” or “Passportdining.com” ) you agree to be bound by that party’s independent privacy policy as stated on their website.

The following policy is solely the information gathering and dissemination policy for Pool & Associates. Upon registering, using, or accessing the passportunlimited.net website (directly or via a mobile app or other device) or purchasing a Passport Unlimited membership through Pool & Associates, Inc., you agree to the following and our Terms of Use, as such terms may be modified and communicated to you from time to time. 

Collection and Handling of Personal Information

Pool & Associates collects personal information when you sign into our website (or mobile app), register or update a member profile, submit a survey, or submit a form. The personal information collected and stored by Pool & Associates is limited to the data in your member profile, including first and last name, physical address, email address, and mobile device identifier. When you use the passportunlimited.net mobile app through your device, we collect your device identifier. We use that identifier to send you notifications and provide access to our services on your device.

Additionally, your IP address will be temporarily stored in our log files but is never associated to your member profile. Pool & Associates will not intentionally collect or use any sensitive information, such as any personal information specifying medical or health conditions, personal sexuality, racial or ethnic origin, political opinions, religious, ideological, or trade union‐related views or activities or information on social security measures or administrative or criminal proceedings and sanctions. 

When you purchase your Passport Unlimited membership from Pool & Associates, your credit card information may be collected, handled, and stored by Pool & Associates. Pool & Associates agrees to keep that information and your personal information secure and not use it for any purpose other than to provide the services you purchase. Pool & Associates will not intentionally collect or use any sensitive information, such as any personal information specifying medical or health conditions, personal sexuality, racial or ethnic origin, political opinions, religious, ideological or trade union‐related views or activities, or information on social security measures or administrative or criminal proceedings and sanctions. 

Your information is collected and processed principally to provide services to you and for other purposes set forth in this Privacy Policy and the Terms of Use or for such other purpose as you may later authorize. Before your personal data is used by Pool & Associates for a purpose that is materially different than those set forth in this Privacy Policy or the Terms of Use, you will be provided with notice and an opportunity to optout and Pool & Associates also agrees not to use such information for a materially different purpose without notifying you.

Your personal information will not be provided to third parties other than a credit card processing service other than as expressly provided for herein. Your personal information may also be stored or processed with third-party service providers and data controllers as part of the platform and infrastructure necessary for us to provide the services to you. These third parties include but are not limited to cloud storage and cloud computing service providers, co‐location services providers, database and image mirroring service providers, backup services, and others. Under certain circumstances, Pool & Associates may be required to disclose your personal information in response to valid requests by public authorities to meet national security or law enforcement requirements.

Pool & Associates may release account and other personal information when appropriate to comply with the law; enforce or apply the Terms of Use and other agreements; or protect the rights, property, or safety of or Pool & Associates or our users, or others. This may include exchanging information with other companies and organizations for fraud protection and credit risk reduction. However, this does not include selling, renting, sharing, or otherwise disclosing personally identifiable information from customers for commercial purposes in violation of the commitments
set forth in this Privacy Policy.

In the unlikely event that Pool & Associates’ assets are acquired or a third party commits to do so, customer information will be one of the transferred assets reviewed or shared.

When you visit the Passportunlimited.net website, we may also automatically gather certain information, including activity metrics, and store it in log files. This information may include, Internet Protocol (IP) addresses, member identifier or other device identifiers, browser information, Internet Service Provider (ISP), operating system, location, date/time stamp, and clickstream and activity event data. Some of this information is generated as part of the basic internet infrastructure and is necessary to provide the services to you. Pool & Associates also uses this information to improve our
website, mobile app, and other services and we may apply various third-party analytics tools in reviewing your personal data.

With your permission through opt-in on the Passportunlimited.net website or mobile app, Pool & Associates may also use your personal information to send you newsletters, information about PassportUnlimited.net offerings, or other promotional materials. Pool & Associates may also update our mobile applications to offer automatic (or “push”) notifications. Pool & Associates will provide push notifications only to those customers who opt-in to receive such notifications. 

If you have questions about location and notification privacy, please contact your mobile service provider or the manufacturer of your device to learn how to adjust your settings. Pursuant to its policies offered at the time of purchase of your membership or later, Pool & Associates may also use your personal information to send you newsletters, information about PassportUnlimited.net or Pool & Associates, or other promotional materials.

Security

Pool & Associates maintains reasonable procedures to help ensure that personal information is reliable for its intended use, accurate, complete, and current. The Personal Information you provide us for registration or login via our website, mobile apps, or webforms will be entered and transmitted using 256‐bit (or greater) SSL encryption. Such information is stored behind a firewall on a secure server but not in an encrypted form. In addition, Pool & Associates also maintains reasonable procedures to help ensure that personal information is reliable for its intended use, accurate, complete, and current and to reasonably protect such information from inadvertent disclosure. 

However, please recognize that email, and other methods of communication such as texting, are not encrypted and cannot be made secure. Pool & Associates therefore advises that you do not send any confidential or personal information such as credit card or account numbers to us through an unsecured email or text. Furthermore, there is no guarantee that even encrypted information transmitted by encrypted means can ever be 100% secure. We both therefore disclaim any and all liability for disclosure of profile or personal information, regardless of whether such liability arises from errors in transmission or unauthorized acts of third parties, or for any other reason, and we are not responsible for transactions between you and the third-party vendors who provide you with goods and services or for any occurrences of fraudulent or alleged fraudulent or wrongful or unauthorized activity relating to any credit, debit or payment card or other method of payment or for information you share with such vendors nor for the security of your transactions with the vendors or of personal or sensitive information transmitted by you to the vendors and stored and used by the vendors, whether transmitted through the Program website, through hyperlinks or direct by you to the vendor.

Geo-locating

Although you do not have to provide your location information to Pool & Associates to use our mobile applications, our services may require your current city and state location to function to maximize your options for finding vendors near you. You may manually enter a partial address and we will save your entry(ies) for future reference. Alternatively, when you download or install our mobile application, you may choose to allow it to obtain your precise location from your mobile device when you click the “current location” button and we will determine your location from the precise location data received from your mobile device. We do store precise location data unless you opt-out, and we do store the zip code or partial address associated with your location.

Aggregate Information; Customer Comments/suggestions

Pool & Associates uses non-identifying and aggregate information to better design our website and to share with advertisers and internet analytical companies such as Google and Yahoo. For example, we may tell an advertiser that X number of individuals visited a certain area on our website, or that Y number of men and Z number of women filled out our registration form, but we would not disclose any Personal Information to the vendors that could be used to identify those individuals. Pool & Associates uses web forms throughout its website (or mobile app) for customer comments and suggestions. Pool & Associates will make an effort to respond to your questions or comments in a prompt manner. Any information we collect from emails or web forms is used for the purpose of responding to your questions or comments. Pool & Associates may also file your comments to improve our site (or mobile app) and program or review and discard the information.

Cookies

When you access the PassportUnlimited.net. website, Pool & Associates, or companies that we hire to track how our website is used, may place small data files called “cookies” on your computer. Pool & Associates and our service providers also use cookies to customize content and advertising; measure promotional effectiveness, and promote trust and safety. Pool & Associates sends a “session cookie” to your computer when you log in to your account or otherwise use the Services. This type of cookie helps us to recognize you if you visit multiple pages on our site during the same session so that we don’t need to ask you for your password on each page. Once you log out or close your browser, this cookie expires and no longer has any effect. Pool & Associates also uses longer-lasting cookies for other purposes such as the “remember me” feature to display your e-mail address or account access information on our sign-in form, so that you don’t need to retype the e-mail address each time you log in to your account or to use the service. Pool & Associates encodes our cookies so that only we can interpret the information stored in them. [Pool & Associates Inc.] (“Pool & Associates Inc. dba Passport Unlimited Midwest”, “we”, or “us”) operates a mobile messaging program (the “Program”) subject to these Mobile Messaging Terms and Conditions (the “Mobile Messaging Terms”). The Program and our collection and use of your personal information is also subject to our Privacy Policy [https://passportunlimited.net/privacy-policy/ By enrolling, signing up, or otherwise agreeing to participate in the Program, you accept and agree to these Mobile Messaging Terms and our Privacy Policy.

1. Program Description: We may send promotional and transactional mobile messages in various formats through the Program. Promotional messages advertise and promote our products and services and may include [promotions, specials, other marketing offers, and abandoned checkout reminders]. Transactional messages relate to an existing or ongoing transaction and may include [order notifications and updates, appointment reminders, and other transaction-related information]. Mobile messages may be sent using an automated technology, including an autodialer, automated system, or automatic telephone dialing system. Message frequency will vary [but will not exceed 5 messages per month]. User Opt-In: By providing your mobile phone number to us, you are voluntarily opting in to the Program and you agree to receive recurring mobile messages from us at the mobile phone number associated with your opt-in, even if such number is registered on any state or federal “Do Not Call” list. You agree that any mobile phone number you provide to us is a valid mobile phone number of which you are the owner or authorized user. If you change your mobile phone number or are no longer the owner or authorized user of the mobile phone number, you agree to promptly notify us at [memberservices@passportunlimited.net]. Your participation in the Program is not required to make any purchase from us and your participation in the Program is completely voluntary.

3. User Opt-Out and Support: You may opt-out of the Program at any time. If you wish to opt-out of the Program and stop receiving mobile messages from us, or you no longer agree to these Mobile Messaging Terms, reply STOP, QUIT, CANCEL, OPT-OUT, and/or UNSUBSCRIBE to any mobile message from us. You may continue to receive text messages for a short period while we process your request and you may receive a onetime opt-out confirmation message. You understand and agree that the foregoing is the only reasonable method of opting out. For support, reply HELP to any mobile message from us. Our mobile messaging platform may not recognize requests that modify the foregoing commands, and you agree that we and our service providers will not be liable for failing to honor requests that do not comply with the requirements in these Mobile Messaging Terms. We may also change the telephone number or short code we use to operate the Program and we will notify you of any such change. You acknowledge that any requests sent to a telephone number or short code that has been changed may not be received by us and we will not be responsible for failing to honor a request sent to a telephone number or short code that has been changed. 

4. Disclaimer of Warranty and Liability: The Program is offered on an “as-is” basis and may not be available in all areas, at all times, or on all mobile providers. You agree that neither we nor our service providers will be liable for any failed, delayed, or misdirected delivery of any mobile message or information sent through the Program. 

5. Modifications: We may modify or cancel the Program or any of its features at any time, with or without notice. To the extent permitted by applicable law, we may also modify these Mobile Messaging Terms at any time. Any such modification will take effect when it is posted to our website. You agree to review these Mobile Messaging Terms periodically to ensure that you are aware of any modifications. Your continued participation in the Program will constitute your acceptance of those.
